Toxic gas adds to a long history of pollution in southwest Memphis

For many years, Rose Sims had no idea what was going on inside a nondescript brick building on Florida Street a couple of miles from her modest one-story home on the southwestern side of town.Like other residents, she got an unwelcome surprise in October 2022 at a public forum held by the Environmental Protection Agency (EPA) at the historic Monumental Baptist Church, known for its role in the civil rights movement. The EPA notified the predominantly Black community that Sterilization Services of Tennessee — which began operations in the brick building in the 1970s — had been emitting unacceptably high levels of ethylene oxide, a toxic gas commonly used to disinfect medical devices.Airborne emissions of the colorless gas can increase the risk of certain medical conditions, including breast cancer. Sims, who is 59 and Black, said she developed breast cancer in 2019, despite having no family history of it and she suspects ethylene oxide was a contributing factor.“I used to be outside a lot. I was in good health. All of a sudden, I got breast cancer,” she said.The drivers of environmental racism include the promise of tax breaks for industry to locate a facility in a heavily minority community, said Malini Ranganathan, an urban geographer at American University in Washington, D.C. The cheaper cost of land also is a factor, as is the concept of NIMBY — or “not in my backyard” — in which power brokers steer possible polluters to poorer areas of cities.A manager at Sterilization Services’ corporate office in Richmond, Virginia, declined to answer questions from KFF Health News. An attorney with Leitner, Williams, Dooley & Napolitan, a law firm that represents the company, also declined to comment. Sterilization Services, in a legal filing asking for an ethylene oxide-related lawsuit to be dismissed, said the use of the gas, which sterilizes about half the medical devices in the U.S., is highly regulated to ensure public safety.Besides southwest Memphis, there are nearly two dozen locales, mostly small cities — from Athens, Texas to Groveland, Florida and Ardmore, Oklahoma — where the EPA said in 2022 that plants sterilizing medical devices emit the gas at unusually high levels, potentially increasing a person’s risk of developing cancer.The pollution issue is so bad in southwest Memphis that even though Sterilization Services planned to close shop by April 30, local community leaders have been hesitant to celebrate. In a letter last year to a local Congress member, the company said it has always complied with federal, state and local regulations. The reason for its closure, it said, was a problem with renewing the building lease.But many residents see it as just one small win in a bigger battle over environmental safety in the neighborhood.“It’s still a cesspool of pollution,’’ said Yolonda Spinks, of the environmental advocacy organization Memphis Community Against Pollution, about a host of hazards the community faces.The air in this part of the city has long been considered dangerous. An oil refinery spews a steady plume of white smoke. A coal plant has leaked ash into the ground and the groundwater. The coal plant was replaced by a natural gas power plant, and now the Tennessee Valley Authority, which provides electricity for local power companies, plans to build a new gas plant there. A continual stream of heavy trucks chug along nearby highways and roads. Other transportation sources of air pollution include the Memphis International Airport and barge traffic on the nearby Mississippi River.Lead contamination is also a concern, not just in drinking water but in the soil from now-closed lead smelters, said Chunrong Jia, a professor of environmental health at the University of Memphis. Almost all the heavy industry in Shelby County — and the associated pollutants — are located in southwest Memphis, Jia added.Sources of pollution are often “clustered in particular communities,” said Darya Minovi, a senior analyst with the Union of Concerned Scientists, a nonprofit that advocates for environmental justice. When it comes to sterilizing facilities that emit ethylene oxide, areas inhabited largely by Black, Hispanic, low-income and non-English-speaking people are disproportionately exposed, the group has found.Four sites that the EPA labeled high-risk are in low-income areas of Puerto Rico. Seven sterilizer plants operate in that U.S. territory.The EPA, responding to public concerns and to deepened scientific understanding of the hazards of ethylene oxide, recently released rules that the agency said would greatly reduce emissions of the toxic gas from sterilizing facilities.KeShaun Pearson, who was born and raised in south Memphis and has been active in fighting environmental threats, said he is frustrated that companies with dangerous emissions are allowed to create “toxic soup” in minority communities.In the area where the sterilization plant is located, 87 percent of the residents are people of color, and, according to the Southern Environmental Law Center, life expectancy there is about 10 years lower than the average for the county and state. The population within 5 miles of the sterilizer plant is mostly low-income, according to the Union of Concerned Scientists.Pearson was part of Memphis Community Against the Pipeline, a group formed in 2020 to stop a crude oil pipeline that would have run through Boxtown, a neighborhood established by emancipated slaves and freedmen after the signing of the Emancipation Proclamation of 1863.That campaign, which received public support from former Vice President Al Gore and actress-activist Jane Fonda, succeeded. After the ethylene oxide danger surfaced in 2022, the group changed the last word of its name from “pipeline” to “pollution.”Besides breast and lymphoid cancers, animal studies have linked inhaling the gas to tumors of the brain, lungs, connective tissue, uterus and mammary glands.Last year, with the help of the Southern Environmental Law Center, the south Memphis community group urged the Shelby County Health Department to declare the ethylene oxide situation a public health emergency and shut down the sterilizing plant. But the health department said the company had complied with its existing air permit and with the EPA’s rules and regulations.A health department spokesperson, Joan Carr, said Shelby County enforces EPA regulations to ensure that companies comply with the federal Clean Air Act and that the agency has five air monitoring stations around the county to detect levels of other pollutants.When the county and the Tennessee Department of Health did a cancer cluster study in 2023, the agencies found no evidence of the clustering of high rates of leukemia, non-Hodgkin lymphoma, or breast or stomach cancer near the facility. There were “hot and cold spots” of breast cancer found but the study said it could not conclude that the clusters were linked to the facility.Scientists have criticized the study’s methodology, saying it did not follow the Centers for Disease Control and Prevention’s recommendations for designing a cancer cluster investigation.Meanwhile, several people have sued the sterilizing company, claiming their health has been affected by the ethylene oxide emissions. In a lawsuit seeking class-action status, Reginaé Kendrick, 21, said she was diagnosed with a brain tumor at age 6. Chemotherapy and radiation have stunted her growth, destroyed her hair follicles and prevented her from going through puberty, said her mother, Robbie Kendrick.In response to proposed stricter EPA regulations, meanwhile, the Tennessee attorney general helped lead 19 other state AGs in urging the agency to “forgo or defer regulating the use of EtO by commercial sterilizers.”Sims said she’s glad her neighborhood will have one less thing to worry about once Sterilization Services departs. Lead contamination is also a concern, not just in drinking water but in the soil from now-closed lead smelters, said Chunrong Jia, a professor of environmental health at the University of Memphis. Almost all the heavy industry in Shelby County — and the associated pollutants — are located in southwest Memphis, Jia added.

Sims said she’s glad her neighborhood will have one less thing to worry about once Sterilization Services departs. But her feelings about the closure remain tempered.

“Hope they don’t go to another residential area,” she said.

Trump’s EPA' in 2025: A Fossil Fuel-Friendly Approach to Deregulation

The Trump administration has reshaped the Environmental Protection Agency, reversing pollution limits and promoting fossil fuels

WASHINGTON (AP) — The Trump administration has transformed the Environmental Protection Agency in its first year, cutting federal limits on air and water pollution and promoting fossil fuels, a metamorphosis that clashes with the agency’s historic mission to protect human health and the environment.The administration says its actions will “unleash” the American economy, but environmentalists say the agency’s abrupt change in focus threatens to unravel years of progress on climate-friendly initiatives that could be hard or impossible to reverse.“It just constantly wants to pat the fossil fuel business on the back and turn back the clock to a pre-Richard Nixon era” when the agency didn’t exist, said historian Douglas Brinkley.Zeldin has argued the EPA can protect the environment and grow the economy at the same time. He announced “five pillars” to guide EPA’s work; four were economic goals, including energy dominance — Trump’s shorthand for more fossil fuels — and boosting the auto industry.Zeldin, a former New York congressman who had a record as a moderate Republican on some environmental issues, said his views on climate change have evolved. Many federal and state climate goals are unattainable in the near future — and come at huge cost, he said.“We should not be causing … extreme economic pain for an individual or a family” because of policies aimed at “saving the planet,” he told reporters at EPA headquarters in early December.But scientists and experts say the EPA's new direction comes at a cost to public health, and would lead to far more pollutants in the environment, including mercury, lead and especially tiny airborne particles that can lodge in lungs. They also note higher emissions of greenhouse gases will worsen atmospheric warming that is driving more frequent, costly and deadly extreme weather.Christine Todd Whitman, a Republican who led the EPA for several years under President George W. Bush, said watching Zeldin attack laws protecting air and water has been “just depressing.” “It’s tragic for our country. I worry about my grandchildren, of which I have seven. I worry about what their future is going to be if they don’t have clean air, if they don’t have clean water to drink,” she said.The EPA was launched under Nixon in 1970 with pollution disrupting American life, some cities suffocating in smog and some rivers turned into wastelands by industrial chemicals. Congress passed laws then that remain foundational for protecting water, air and endangered species.The agency's aggressiveness has always seesawed depending on who occupies the White House. Former President Joe Biden's administration boosted renewable energy and electric vehicles, tightened motor-vehicle emissions and proposed greenhouse gas limits on coal-fired power plants and oil and gas wells. Industry groups called rules overly burdensome and said the power plant rule would force many aging plants to shut down. In response, many businesses shifted resources to meet the more stringent rules that are now being undone.“While the Biden EPA repeatedly attempted to usurp the U.S. Constitution and the rule of law to impose its ‘Green New Scam,’ the Trump EPA is laser-focused on achieving results for the American people while operating within the limits of the laws passed by Congress,” EPA spokeswoman Brigit Hirsch said. Zeldin's list of targets is long Much of EPA’s new direction aligns with Project 2025, the conservative Heritage Foundation road map that argued the agency should gut staffing, cut regulations and end what it called a war on coal on other fossil fuels.“A lot of the regulations that were put on during the Biden administration were more harmful and restrictive than in any other period. So that’s why deregulating them looks like EPA is making major changes,” said Diana Furchtgott-Roth, director of Heritage's Center for Energy, Climate, and Environment.But Chris Frey, an EPA official under Biden, said the regulations Zeldin has targeted “offered benefits of avoided premature deaths, of avoided chronic illness … bad things that would not happen because of these rules.”Matthew Tejada, a former EPA official under both Trump and Biden who now works at the Natural Resources Defense Council, said of the revamped EPA: “I think it would be hard for them to make it any clearer to polluters in this country that they can go on about their business and not worry about EPA getting in their way.”Zeldin also has shrunk EPA staffing by about 20% to levels last seen in the mid-1980s. Justin Chen, president of the EPA’s largest union, called staff cuts “devastating.” He cited the dismantling of research and development offices at labs across the country and the firing of employees who signed a letter of dissent opposing EPA cuts. Relaxed enforcement and cutting staff Many of Zeldin's changes aren't in effect yet. It takes time to propose new rules, get public input and finalize rollbacks. It's much faster to cut grants and ease up on enforcement, and Trump's EPA is doing both. The number of new civil environmental actions is roughly one-fifth what it was in the first eight months of the Biden administration, according to the nonprofit Environmental Integrity Project. “You can effectively do a lot of deregulation if you just don’t do enforcement,” said Leif Fredrickson, visiting assistant professor of history at the University of Montana.Hirsch said the number of legal filings isn't the best way to judge enforcement because they require work outside of the EPA and can bog staff down with burdensome legal agreements. She said the EPA is “focused on efficiently resolving violations and achieving compliance as quickly as possible” and not making demands beyond what the law requires.EPA's cuts have been especially hard on climate change programs and environmental justice, the effort to address chronic pollution that typically is worse in minority and poor communities. Both were Biden priorities. Zeldin dismissed staff and canceled billions in grants for projects that fell under the “diversity, equity and inclusion” umbrella, a Trump administration target.He also spiked a $20 billion “green bank” set up under Biden’s landmark climate law to fund qualifying clean energy projects. Zeldin argued the fund was a scheme to funnel money to Democrat-aligned organizations with little oversight — allegations a federal judge rejected. Pat Parenteau, an environmental law expert and former director of the Environmental Law School at Vermont Law & Graduate School, said the EPA's shift under Trump left him with little optimism for what he called “the two most awful crises in the 21st century” — biodiversity loss and climate disruption.“I don’t see any hope for either one,” he said. “I really don’t. Railroad company appeals water pollution fine after train crash into Oregon river

The Department of Environmental Quality fined the railroad company $81,600 after the January crash.

The railroad company whose trestle collapsed earlier this year, derailing a train into the Marys River in Corvallis, has appealed a fine for water pollution stemming from the incident, denying state officials’ versions of events.Included in the Department of Environmental Quality penalty notice that fined Portland & Western Railroad $81,600 fine was an order that the company inspect all its water crossing trestles for safety concerns and formulate a process for evaluating and prioritizing repairs, modifications or replacement.‘Reckless disregard’In January, the train bridge spanning Avery Park and Pioneer Park gave way under a 19-car freight train carrying pelletized fertilizer, dropping one railcar into the Marys River and leaving another partially in the water.The derailment spilled 199 tons of urea into the river over nine days, according to the DEQ. Urea, which can be synthesized or harvested from animal urine and is used in fertilizer, both sinks and dissolves in water.DEQ alleges the derailment was caused by reckless disregard on the part of Portland & Western Railroad Inc., issuing a civil penalty of $81,600 to the company in a notice made public Friday, Dec. 19.Several attempts, by email and phone, to reach railroad officials went unanswered.The appealPortland & Western Railroad filed an appeal the same day, according to a document provided by the DEQ. The agency initially reported that it wasn’t sure the appeal was filed by the established deadline.The company has requested a hearing with the agency over the penalty and denies several of the DEQ’s findings outlined in the notice.In its appeal, the company denies that the Jan. 4 incident “had a significant adverse impact on human health and the environment.” It also denies that railcars continued to release urea into the river through Jan. 12, as the DEQ alleges.Furthermore, Portland & Western Railroad denies the “characterization of and the related factual allegations regarding the condition of the bridge.” It also denies how the state characterized the railroad’s actions with respect to ”the inspection, maintenance and operation of the bridge.”In its defense, the Portland & Western Railroad appeal claims the bridge failure was an “act of God/Nature,” saying river flooding generated unusually high and fast-flowing water at the time and was a significant contributing factor to the collapse.The state has said urea can pollute water by introducing excessive nitrogen that promotes algal blooms, depletes dissolved oxygen and disrupts aquatic ecosystems. When it breaks down into ammonia, it can be toxic to aquatic organisms.Precipitating event?In May 2022, the trestle caught fire and took nearly nine hours to extinguish. Witnesses reported hearing explosions, possibly from propane tanks at a homeless encampment under the bridge.At the time, a spokesperson for Portland & Western Railroad Inc. said the structure had been “inspected thoroughly” and repairs were made before rail traffic resumed.The DEQ says the company in fact made only “minor repairs” at the trestle damaged in the 2022 fire and ”continued running freight trains over it” rather than replacing it.“Given the threat to human health, safety and the environment posed by a train accident involving freight such as chemicals, disregarding that risk constituted a gross deviation from the standard of care a reasonable person would observe in that situation,” the DEQ said in the penalty notice.As such, the state is demanding Portland & Western reinspect every trestle over a body of water in Oregon.However, in the appeal the railroad company is denying that it operates approximately 478 miles in Oregon. The railroad was bought by Genesee & Wyoming Inc. in 1995 but still uses the Portland & Western name locally.

Catherine Blakespear held a joint hearing of the Senate Environmental Quality Committee and the Assembly Environmental Safety and Toxic Materials Committee in San Diego Thursday to explore how the state can help solve the problem. “California has long been a national leader in environmental stewardship and policy making,” Blakespear said at the hearing. “But what is happening in the Tijuana River Valley is an international environmental disaster that undermines everything that California stands for.” The hearing at Scripps Institution of Oceanography in La Jolla, convened scientists and civic leaders to discuss how failed infrastructure, industrial waste and decades of neglect created the environmental disaster, and what it will take to fix it. “Due to its international nature, we know the federal government must take the lead,” Blakespear said. “Still, there is much that the state and local governments can do.” After decades of stalemate, action on Tijuana River pollution is speeding up. The U.S. Environmental Protection Agency on Monday announced a new agreement with Mexico to plan for wastewater infrastructure to accommodate future population growth in Tijuana. On Wednesday State Sen. Steve Padilla introduced a bill to update state standards for hydrogen sulfide, a noxious gas with a rotten egg smell that’s produced by sewage in the river. Residents in the area complain of headaches, nausea and other ailments when hydrogen sulfide reaches high concentrations. The bill would require the California Air Resources Board to review the half-century-old standard and tighten it if needed. State Lawmakers also aim to improve conditions for lifeguards and other workers exposed to pollution, and hold American companies accountable for their role in contamination of the river. County officials will conduct an extensive health study to measure effects of Tijuana River pollution, and are making plans to remove a pollution hot spot in Imperial Beach. Ongoing, chronic pollution Sewage spills in south San Diego County became common in the early 2000s, sickening swimmers and surfers at local beaches. Then the aging wastewater plants failed, sending hundreds of millions of gallons of raw sewage into the ocean. Last year Scripps researchers found that the river is harming nearby communities by releasing airborne chemicals including hydrogen sulfide gas, which smells like rotten eggs. “The sewage flowing into San Diego County’s Coastline is poisoning our air and water, harming public health, closing beaches, and killing marine life,” Blakespear said.  San Diego officials have successfully lobbied for federal investment to upgrade aging wastewater treatment plants. They also introduced faster water quality testing and surveyed residents to understand health issues.  Paula Stigler Granados, a professor of public health at San Diego State University, said studies of people living near the Tijuana River found “more scary stuff,”  with 45% experiencing health problems, 63% saying pollution disrupted their work or school and 94% of respondents reporting sewage smells at home.  “Children are waking up sick in the middle of the night,” she said. “This is an ongoing, chronic exposure, not a one-time event.” A section of the Tijuana River next to Saturn Boulevard in San Diego on Nov. 21, 2025. Photo by Adriana Heldiz, CalMatters Water samples revealed industrial chemicals, methamphetamine, fentanyl, restricted pesticides, pharmaceuticals and odor-causing sulfur compounds, she said. “This is absolutely a public health emergency,” Stigler Granados said. “I do think it is the biggest environmental crisis we have in the country right now.” That sense of urgency isn’t universal. Last year Gov. Gavin Newsom declined requests by San Diego officials to declare a state of emergency over the border pollution problem, saying it “would have meant nothing.” Over the last two years State Sen. Steve Padilla has introduced legislation to fund improvements to wastewater treatment, limit landfill construction in the Tijuana River Valley and require California companies to report waste discharges that affect water quality in the state, but those bills failed. He said the problem is overlooked in this border area, with its low-income and working class population. “This is one of the most unique and acute environmental crises in all of North America,” Padilla said. “It is underappreciated simply because of where it is occurring.”  Tijuana River solutions This year the U.S. repaired the failing South Bay International Wastewater Treatment Plant and expanded its capacity from 25 million to 35 million gallons of wastewater per day. In April, Mexico repaired its Punta Bandera plant near the border, reducing sewage flows into the ocean. But the Imperial Beach shoreline has remained closed for three years, and residents still complain of headaches, nausea, eye irritation and respiratory ailments from airborne pollution. That problem is worst at a point known as the Saturn Blvd. hot spot in Imperial Beach, where flood control culverts churn sewage-tainted water into foam, spraying contaminants into the air. “When the water is polluted you can close the beach,” said Kim Prather, an atmospheric chemist at Scripps, who identified the airborne toxins. “But you can’t tell people not to breathe.” Community members feel forgotten by state leaders as they face chronic air pollution and years of closed beaches because of contaminated wastewater from the Tijuana River, said Serge Dedina, executive director of the environmental organization WildCoast and former Imperial Beach mayor. “What they say is ‘how come California doesn’t care about us?’” Dedina said. As federal authorities plan expansions to the South Bay International Wastewater Treatment Plant that will boost its capacity to 50 million gallons per day, local and state leaders have their own action plan. A top priority for Aguirre is removing culverts at the Saturn Blvd. hot spot that cause airborne pollution. “That’s low hanging fruit that we don’t need to depend on the federal government to fix,” Aguirre said. She hopes to get funding for that project from Proposition 4, the state environmental bond that voters passed earlier this year. It dedicates $50 million to cleaning up degraded waterways, including the Tijuana River and New River, which flows into the Salton Sea.  The county is also planning a health study that would include physiological measurements to determine the health effects of Tijuana River pollution. “What we’re working on is how are we going to take real, hard medical data and follow a cohort of people who live in this environment, so we can understand what is happening in their bodies,” Aguirre said. “What is happening to children and seniors? What is in their bloodstreams?” San Diego County has distributed about 10,000 home air purifiers to households near the Tijuana River, but Aguirre wants to provide devices to all 40,000 homes in the affected area. Dedina said his organization is removing waste tires that are exported to Mexico and wash back into the Tijuana River Valley. “My lesson here is we need to stop the sediment, the tires, the trash, the toxic waste, the sewage,” he said. In addition to his bill updating hydrogen sulfide standards, Padilla said he’s exploring legislation to regulate pollution created by California companies operating through maquiladoras in Mexico. He wants to work with Mexico “to put some pressure on them to basically clamp down on American companies that are licensed to do business here in California. Blakespear said she wants to protect lifeguards and other public workers exposed to pollution. Whether the solution is creating environmental standards for international businesses or funding costly infrastructure, lawmakers acknowledge that the binational nature of the problem makes it tough to solve. “The complexity around it being an international issue and being a federal issue has added to the difficulties about who should act,” Blakespear said.
