The Biological Threat Research Laboratory (BTRL) at Texas Tech University was instrumental in identifying the first case of highly pathogenic avian influenza (HPAI) A (H5N1) being transmitted from a mammal (dairy cow) to a human.

The case was made public in an article published in the New England Journal of Medicine. Steve Presley, the director of The Institute of Environmental and Human Health (TIEHH) and the BTRL, and Cynthia Reinoso Webb, the biological threat coordinator at TIEHH, were co-authors on the journal publication.

The journal article explains that in March a farm worker who reported no contact with sick or dead birds, but who was in contact with dairy cattle, began showing symptoms in the eye and samples were collected by the regional health department to test for potential influenza A.

Initial testing of the samples was performed at the BTRL, which is a component of the Centers for Disease Control and Prevention (CDC) Laboratory Response Network-Biological (LRN-B) located at TIEHH.

Significance of the Case

“It’s a huge thing that the virus has jumped from birds to mammals, dairy cows in this case, and then to humans,” Presley said. “That’s why this paper in the New England Journal of Medicine is very significant. It’s going to lay the foundation, I believe, for a lot of research in the future of how the virus is evolving.”

The involvement of Texas Tech’s BTRL is a continuation of the partnership between regional, state, and federal public health partners.

‘How did we miss this for so long?’: The link between extreme heat and preterm birth

Heat waves are making pregnancy more dangerous and exacerbating existing maternal health disparities.

When Rupa Basu was pregnant with her second child, her body temperature felt out of control — particularly as her third trimester began in the summer of 2007. It wasn’t particularly hot in Oakland, California, with high temperatures reaching 80 degrees Fahrenheit. Still, she felt uncomfortably warm even as her colleagues and friends were unbothered. As her October due date approached, she drank extra fluids and avoided going outside during the hottest stretch of the day. “This is really weird,” she recalls thinking. She wondered if there could be a biological mechanism at work.  That notion had troubling implications. “If this is a biological response, imagine what’s happening in places like India and Africa where the heat can get to an unbearable 130 degrees Fahrenheit,” Basu remembers thinking. As a researcher at the California Environmental Protection Agency’s Office of Environmental Health Hazard Assessment, Basu knew that other vulnerable populations, notably the elderly, were particularly susceptible to heat.  But she couldn’t find any answers to one fundamental question: do higher temperatures lead to premature births or other pregnancy complications?  Rupa Basu poses for a photo while pregnant with her second child in June 2007. Courtesy of Rupa Basu As Basu prepared for her second baby’s delivery, she began gathering state weather data and birth records to identify preterm births, those that occur prior to 37 weeks of gestation. Preterm birth is linked to a wide variety of health conditions, including anemia, respiratory distress, jaundice, sepsis, and retinopathy — and, at worst, infant mortality. Researchers, including Basu, had already documented the impacts of air pollution on adverse pregnancy outcomes. But heat was, at the time, uncharted terrain — and the suggestion that it might have an effect was met with skepticism. Colleagues, particularly those who had not ever been pregnant, implied she was wasting her time. But when Basu published her study, her findings spurred similar research all over the world.  Basu analyzed 60,000 summertime births — those taking place between May and September — from 1999 to 2006, across 16 California counties. She found higher rates of preterm births during higher temperatures. She published the research in 2010, and even though she focused on California, it was the first large-scale epidemiological study looking at preterm delivery and temperature conducted anywhere in the world.  What was especially shocking, Basu said, was how much greater the risk was for Black mothers — 2.5 times higher than for white populations. “How did we miss this for so long?” Basu asked. “Women are often the last to get studied. But the most vulnerable people are those who are pregnant.” Those vulnerabilities are intensifying. In the last year, the hottest on record, 6.3 billion people — notably in South and East Asia and the African Sahel — experienced at least 31 days of extreme heat, hotter than 90 percent of documented temperatures between 1991 and 2020, according to a new report.  Breast milk is fed via tubes to a preterm infant at a neonatal intensive care unit in Washington, D.C., in 2017. Without intervention, those heat waves will cause millions of babies around the world to be born preterm. Higher temperatures will also have knock-on impacts to gestational and fetal health. As temperatures rise, so does drought and air pollution, which also increases the risk of preterm birth or low birthweight babies. Pollutants from vehicle combustion, including nitrogen oxides and volatile organic compounds, react in sunlight to form ozone. And the U.S. Environmental Protection Agency calculated that extreme heat events will also lead to more wildfires, leading to air pollution that is expected to cause thousands of additional preterm births.  Basu began research on pregnant people because they are woefully understudied and they represent one of the most vulnerable populations. Now that there is strong evidence that heat exacerbates adverse birth outcomes, she hopes it will instigate policy change, promote awareness, and ultimately, decrease risk and disparities. “We need to take more action,” she said. “This is preventable.” Emergency medical technicians respond to a pregnant woman suffering from dehydration in July 2023 in Eagle Pass, Texas. Brandon Bell / Getty Images In the 14 years since Basu’s initial paper, dozens of studies have confirmed that higher temperatures and heat waves are linked to preterm birth as well as stillbirth.  In 2020, Basu co-authored a review of 57 studies that found a significant association between air pollution and heat exposure with preterm birth and low birth weight. Scientists have found an association between heat exposure and preterm birth rates in every developed nation, and in the few developing nations to conduct studies so far.  While it’s not yet clear how heat triggers preterm birth, there are several hypotheses — including dehydration, hormonal releases that rupture membranes surrounding the fetus, or poor blood flow between parent and unborn child. This research has taken place against a backdrop of a worsening maternal health crisis in the U.S., particularly in marginalized communities. The U.S. has the highest rate of preterm births in the developed world. Kasey Rivas, associate director of strategic partnerships at the March of Dimes and a co-author of a recent report on birth outcomes and disparities, told me that maternal health disparities in the U.S. stem largely from systemic racism and are worsening due to climate change. Bates / Grist A 2023 study found that the average preterm birth rate was 7.9 percent across North America, Australia, New Zealand, and Europe in 2020; but the United States’ preterm birth rate was higher — 10 percent. By comparison, the highest population-wide preterm birth rate in the world is 13.2 percent in South Asia. U.S. rates of preterm birth increased 4 percent between 2020 and 2021 — and rates were far higher in Black women (14.8 percent) compared to white women (9.5 percent), according to the March of Dimes report. “The data were disturbing and disheartening,” Rivas said. In 2023, a team of scientists decided to take a closer look at a notoriously deadly heat wave in Chicago in 1995 during which over 700 died as high humidity made 106 degrees feel like a hellish 120. “If we didn’t see a racial effect during this event, we won’t see it anywhere,” study co-author Joan Casey, an environmental epidemiologist at the University of Washington in Seattle, recently told me.  Casey and her colleagues found convincingly stark racial disparities. The mean monthly incidence of preterm birth rose 16.7 percent beyond what was expected for Black mothers six months after the heat wave. No such link was seen in non-Hispanic white births.  Further, a study conducted in Harris County, Texas, which includes Houston, the fourth largest U.S. city, found that the risk of preterm birth was 15 percent higher following extremely hot days — and had the greatest impact on communities of color that lived in neighborhoods with more concrete than trees. Clayton Aldern / Grist That finding points to the reasons behind the racial gap in preterm births linked to heat waves. Preterm birth has been linked to a number of factors including inadequate nutrition, exposure to air pollution, lack of access to quality health care, lack of air conditioning, or having a job working outdoors — or several of these at once. Heat only worsens existing risks. And communities of color are more likely than white communities to face all of these risk factors, including heat. Predominantly Black neighborhoods were redlined, or deemed most risky, beginning in the 1930s when insurance companies created maps assigning investment risk levels based on race. Today, those redlined areas have more industrial facilities, excessive truck traffic, and a heavier pollution burden — and often, the least shade or green space. Areas dominated by concrete, asphalt, and buildings experience hotter temperatures due to the urban heat island effect, the phenomenon in which gray infrastructure absorbs and holds more heat than forests or waterways.   Fresno County, California, which has some of the worst air pollution in the United States, exemplifies this pattern. Venise Curry, a consultant for community-based organizations collaborating with the UC San Francisco California Preterm Birth Initiative and others on a prenatal research study designed to lower preterm birth rates, told me that the county’s highest preterm birth numbers are in Southwest Fresno — a formerly redlined, predominantly Black neighborhood of color. Luis Sinco / Los Angeles Times Black and white “women experience broadly similar climate changes, but are seeing drastically different outcomes — so something else must be at play,” said Bryttani Wooten, a Ph.D. student at the University of North Carolina at Chapel Hill who has studied racial disparities in preterm birth rates. “That something else is systemic racism, including legacies of residential segregation.”  Obstetric providers in low-income communities of color describe preterm birth as a crisis. “Preterm birth is a 24/7, 365-days-a-year public health emergency in my community,” said Nneoma Nwachuku Ojiaku, an obstetrician in Sacramento. Madeleine Wisner, who was the only midwife provider serving low-income residents in the Sacramento Valley through the state Medicaid program for seven years until recently, described something similar. “A course of maternity care where nothing abnormal happens doesn’t exist any longer in the populations I was serving,” Wisner said. She’s seen a range of birth complications — including abnormally implanted placentas, umbilical cord abnormalities, and preeclampsia — in patients who were exposed to heat, air pollution, or wildfire smoke during pregnancy. Black doulas and midwives are a small but growing population determined to improve Black maternal health, said Maya Jackson, the founder of Mobilizing African American Mothers through Empowerment, or MAAME. She said that while Black midwives were once at the forefront of birthing health care for Black and white mothers post-slavery, their systematic exclusion from medical institutions changed that. Today, Jackson is seeking funding to do community-based research on heat impacts on people of color to make sure that their lived experiences and the impacts of policies that shape housing, green spaces, or industrial pollution in brown and black neighborhoods are documented.  “Somehow living has become a political issue,” she said. In March, a study conducted among outdoor workers in India found that exposure to heat stress above 81 degrees F doubled the risk of miscarriage. Overall in India, 8.5 percent of pregnancies in urban areas and 6.9 percent in rural areas end in miscarriage.  Ana Bonell, a researcher at the London School of Hygiene and Tropical Medicine, studies heat and birth outcomes in western Africa and Pakistan. She said it’s difficult to conduct research on maternal climate exposure and adverse birth outcomes in most places in Africa because they often don’t have electronic health records or the equipment needed to accurately determine how far along a pregnancy is — information necessary to determine if a birth is, in fact, preterm. Instead, she looked at acute physiological changes in pregnant farmworkers and their fetuses in The Gambia, a country in West Africa where the average temperature is 83 degrees F. In 2022, she published data showing that the farmworkers exhibited a 17 percent increase in fetal stress, defined by a fetal heart rate either above 160 or below 115 beats per minute or decreased placental blood flow, for each degree Celsius of heat. Education Images / Universal Images Group via Getty Images “[These are] populations that have contributed almost nothing to climate change and are at [the] front lines of the climate crisis,” Bonell said. Research in Ghana, published last year, also found that exposure to temperatures 87 degrees F or higher throughout a pregnancy resulted in an 18 percent increased risk of stillbirth.  “There seems to be this myth of endless adaptation,” said Chandni Singh, a climate researcher at the Indian Institute for Human Settlements. “In tropical countries that are already very hot, there is this continuous expectation to adapt, which is not feasible. You can’t adapt to 45 C” (113 degrees F). And heat has knock-on impacts. “Heat doesn’t come alone; it comes with water scarcity and wildfires,” she said, emphasizing the need to curtail greenhouse gas emissions. Singh has reviewed a number of heat action plans created by city and state governments globally to improve heat advisory messaging or build cooling spaces and environments. She said there is an increasing but still insufficient focus on women, particularly addressing the fact that people who are pregnant or lactating have unique heat adaptation needs.  “We know this is a problem, and certain women are affected more,” said Singh. “How do we deal with that? In 2022, Ojiaku called on Sacramento leaders to improve public health messaging about heat risks — and to appoint a chief heat officer, akin to those in Los Angeles, Phoenix, and Miami, whose job it would be to include pregnant people as at-risk populations in heat advisories.  A March study of 17 federal, 38 state, and 19 city websites with heat-health information found that only seven websites listed pregnant people as vulnerable or at-risk populations.  “We are more likely to see information on how to take care of pets during heat waves than pregnant women,” Ojiaku told me. In addition, she said, creating green spaces such as parks in neighborhoods that have been subject to systemic racism and redlining can offer shade, cool spaces to exercise, and a buffer against air pollution.  “Sacramento is called ‘the city of trees,’ but that’s for a select few in the predominantly wealthier sections of Sacramento,” Ojiaku said. “Other areas are a concrete jungle.”  In 2023, UNICEF, the United Nations Children’s Fund, published a dossier describing measures needed to protect women and children from heat waves. The deterioration coincides with reduced flows into California’s largest lake, a new research paper published today (May 29) in the American Journal of Agricultural Economics finds.Disadvantaged communities have been affected more than others in the areas near the Salton Sea, which has been shrinking for years, said Eric Edwards, the paper’s co-leading author. He is an assistant professor of agricultural economics at the University of California, Davis, who did the research while at North Carolina State University. “We have a dusty area, and any time there is wind, it’s going to pick up dust and move it around,” Edwards said. “We think this new dust is increasing the amount of pollution faced by disadvantaged communities in the region surrounding the lake.”The dry lakebed of Calfironia’s Salton Sea. Credit: Emily C. Dooley, UC DavisAn Overflowing RiverThe Salton Sea formed in 1905 after the Colorado River overflowed its banks and the floodwaters settled into what was known as the Salton Sink. It was primarily fed by water runoff from agricultural operations for almost a century. As the southern part of California struggled to meet growing water demand, the Imperial Irrigation District agreed to send water to San Diego for urban use.Imperial, which supplies water to vast desert farms as well as seven towns and two special districts, is the largest user of Colorado River water. The agreement with San Diego required agricultural water users to increase efficiency and reduce their water consumption, which reduced water running into the Salton Sea, Edwards said.The reductions increased the lake’s salt content, which is higher than in the Pacific Ocean. This also harmed wildlife habitats and created localized air pollution. The area is the subject of many environmental restoration projects.Studying ImplicationsEdwards and others used a particle transport model to study the effects of changing water diversions on particulate pollution.They found that the paths of fine particulate matter — which can cause asthma, heart and respiratory issues when inhaled — were associated with higher air pollution readings after Imperial began reducing runoff water to the Salton Sea around 2011 in order to transfer it to San Diego, a practice that continues today.Researchers modeled lakebed exposure by dividing the lake’s shoreline into 1-square-kilometer grids and collected air pollution data daily for over 20 years, from 1998 to 2018. They added data about the exposed lakebed, or playa, and used a sophisticated physics model called HYSPLIT to factor in wind levels and particle size to track the movement of dust over time. State health screening information available by ZIP code added more to the story by pinpointing disadvantaged areas, asthma rates and other vulnerabilities.Lake levels were higher in 1998 before the transfers, so the change was not evident until later years, when the lakebed became more exposed.“We show that during that post-2011, there is an increase in particles going through disadvantaged communities relative to non-disadvantaged communities, which are farther away from the sea,” Edwards said.In the paper, the pollution paths are depicted on a map of the state. Convening for cultural change

At MIT and internationally, senior Cindy Xie works to bring people together for the health of humanity and the planet.

Whether working with fellow students in the Netherlands to design floating cities or interning for a local community-led environmental justice organization, Cindy Xie wants to help connect people grappling with the implications of linked social and environmental crises.The MIT senior’s belief that climate action is a collective endeavor grounded in systems change has led her to work at a variety of community organizations, and to travel as far as Malaysia and Cabo Verde to learn about the social and cultural aspects of global environmental change.“With climate action, there is such a need for collective change. We all need to be a part of creating the solutions,” she says.Xie recently returned from Kuala Lumpur, where she attended the Planetary Health Annual Meeting hosted by Sunway University, and met researchers, practitioners, and students from around the world who are working to address challenges facing human and planetary health.Since January 2023, Xie has been involved with the Planetary Health Alliance, a consortium of organizations working at the intersection of human health and global environmental change. As a campus ambassador, she organized events at MIT that built on students’ interests in climate change and health while exploring themes of community and well-being.“I think doing these events on campus and bringing people together has been my way of trying to understand how to put conceptual ideas into action,” she says.Grassroots community-buildingAn urban studies and planning major with minors in anthropology and biology, Xie is also earning her master’s degree in city planning in a dual degree program, which she will finish next year.Through her studies and numerous community activities, she has developed a multidimensional view of public health and the environment that includes spirituality and the arts as well as science and technology. “What I appreciate about being here at MIT is the opportunities to try to connect the sciences back to other disciplines,” she says.As a campus ambassador for the Planetary Health Alliance, Xie hosted a club mixer event during Earth Month last year, that brought together climate, health, and social justice groups from across the Institute. She also created a year-long series that concluded its final event last month, called Cultural Transformation for Planetary Health. Organized with the Radius Forum and other partners, the series explored social and cultural implications of the climate crisis, with a focus on how environmental change affects health and well-being.Xie has also worked with the Planetary Health Alliance’s Constellation Project through a Public Service Fellowship from the PKG Center, which she describes as “an effort to convene people from across different areas of the world to talk about the intersections of spirituality, the climate, and environmental change and planetary health.”She has also interned at the Comunidades Enraizadas Community Land Trust, the National Institutes of Health, and the World Wildlife Fund U.S. Markets Institute. And, she has taken her studies abroad through MIT International Science and Technology Initiatives (MISTI). In 2023 she spent her Independent Activities Period in a pilot MISTI Global Classroom program in Amsterdam, and in the summer of 2023, she spent two months in Cabo Verde helping to start a new research collaboration tracking the impacts of climate change on human health.The power of storytellingGrowing up, Xie was drawn to storytelling as a means of understanding the intersections of culture and health within diverse communities. This has largely driven her interest in medical anthropology and medical humanities, and impacts her work as a member of the Asian American Initiative.The AAI is a student-led organization that provides a space for pan-Asian advocacy and community building on campus. Xie joined the group in 2022 and currently serves as a member of the executive board as well as co-leader of the Mental Health Project Team. She credits this team with inspiring discussions on holistic framings of mental health.“Conversations on mental health stigma can sometimes frame it as a fault within certain communities,” she says. “It’s also important to highlight alternate paradigms for conceptualizing mental health beyond the highly individualized models often presented in U.S. higher education settings.”Last spring, the AAI Mental Health team led a listening tour with Asian American clinicians, academic experts, and community organizations in Greater Boston, expanding the group’s connections. That led the group to volunteer last November at the Asian Mental Health Careers Day, hosted by the Let’s Talk! Conference at the Harvard Graduate School of Education. In March, the club also traveled to Yale University to participate in the East Coast Asian American Student Union Conference alongside hundreds of attendees from different college campuses.On campus, the team hosts dialogue events where students convene in an informal setting to discuss topics such as family ties and burnout and overachievement. Recently, AAI also hosted a storytelling night in partnership with MIT Taara and the newly formed South Asian Initiative. “There’s been something really powerful about being in those kinds of settings and building collective stories among peers,” Xie says.Community connectionsWriting, both creative and non-fiction, is another of Xie’s longstanding interests. From 2022 to 2023, she wrote for The Yappie, a youth-led news publication covering Asian American and Pacific Islander policy and politics. She has also written articles for The Tech, MIT Science Policy Review, MISTI Blogs, and more. Last year, she was a spread writer for MIT’s fashion publication, Infinite Magazine, for which she interviewed the founder of a local streetwear company that aims to support victims of sexual violence in the Democratic Republic of Congo.This year, she performed a spoken word piece in the “MIT Monologues,” an annual production at MIT that features stories of gender, relationships, race, and more. Her poetry was recently published in Sine Theta and included in MassPoetry’s 2024 Intercollegiate Showcase. Xie has previously been involved in the a capella group MIT Muses and enjoys live music and concerts as well. Tapping into her 2023 MISTI experience, Xie recently went to the concert of a Cabo Verdean artist at the Strand Theatre in Dorchester. “The crowd was packed,” she says. “It was just like being back in Cabo Verde. I feel very grateful to have seen these local connections.”After graduating, Xie hopes to continue building interdisciplinary connections. “I’m interested in working in policy or academia or somewhere in between the two, sort of around this idea of partnership and alliance building. My experiences abroad during my time at MIT have also made me more interested in working in an international context in the future.”

This Supreme Court Term, Health and Safety Are on the Line

In the coming weeks, the Supreme Court will release several opinions that implicate the health and safety of every American. Citizens may believe that the court’s decisions are far removed from their everyday lives. But this term, at least, they will hit close to home. From the environment, to medical care, to the hot-button issues of guns and abortion, over the past year the court took up a string of cases that will affect how well we live—and how long.  The vast and critically important implications of these coming rulings pose a key question: Should judges be the ones deciding the rules and regulations that so intimately affect Americans’ lives? In case after case, the court is contemplating overruling decisions made by Congress and administrative agencies to protect Americans’ safety. One of the most critical cases this term raises that very issue: who in government gets to decide detailed questions about our medical care, drug safety, chemicals in the air and water, food safety, and much more? It’s likely that in a pair of cases this term, the justices will decide that the best people to make those decisions are unelected judges—and ultimately, the justices themselves. The Chevron case puts thousands of regulations related to Americans’ health and safety at risk. In a set of cases challenging a fishing regulation, the justices are considering whether to end or limit a principle of judicial decision-making called Chevron Deference, under which judges defer to administrative agencies if the law is ambiguous and the agency interpretation is reasonable. The rule was enshrined in the 1984 case Chevron v. National Resources Defense Council, but “this practice of deferring to reasonable agency interpretations of ambiguous statutes was well established in the case law handed down by the Supreme Court” by the mid-1940s, says Miriam Becker-Cohen, an appellate counsel at the liberal Constitutional Accountability Center.  The case implicates thousands of regulations promulgated every year, many having to do with Americans’ health and safety. In an amicus brief, the American Cancer Society warned that deference is critical to the administration of Medicaid, Medicare, and the Children’s Health Insurance Program, which together provide healthcare to nearly half the US population. Agency experts, they argued, are best positioned to interpret statutory terms like “geographic area,” “costs incurred,” and “nursing-related services.” Given the amounts of money spent on health care, without Chevron, litigation would abound. “The resulting uncertainty would be extraordinarily destabilizing, not just to the Medicare and Medicaid programs but also—given the size of these programs—to the operational and financial stability of the country’s health care system as a whole,” the brief warns. The effects of sunsetting Chevron would go far beyond healthcare. Civil rights groups warn that laws protecting minorities in housing, employment, and financial services could be gutted by newly-empowered judges. Agencies, guided by scientists and other experts, work to protect Americans from toxic chemicals, to keep air and water clean, maintain food safety, and on and on. “Is a new product designed to promote healthy cholesterol levels a dietary supplement, or a drug?” Justice Elena Kagan asked during oral arguments, raising just one hypothetical question that, if Chevron were overruled, might transfer from doctors to judges. With changes this broad, everyone’s safety would be implicated. “When the administrative state falls into a sinkhole, or quicksand, because of this court,” Georgetown Law professor Michele Goodwin warns, it will impact how people “actually have a healthy and, in fact, even joyful life.” Guns are another issue critical to Americans’ health and safety. In 2017, a gunman used semi-automatic rifles equipped with bump stocks to fire on concert-goers in Las Vegas. A bump stock is a firearm accessory that turns a semi-automatic rifle into a continuously firing weapon that discharges dozens of bullets in seconds. In 11 minutes, the shooter struck 500 people, killing 60—the deadliest mass shooting in the country’s history. In the aftermath, the Bureau of Alcohol, Tobacco, and Firearms banned bump stocks by defining them as illegal machine guns. In Garland v. Cargill, the justices are weighing whether to overturn that decision. Such a ruling by the court would allow Americans to own, for all intents and purposes, automatic weapons. One need only look to Las Vegas to understand the cases’ significant potential to impact Americans’ health and safety.  Lawmakers say ending the bump stock ban would “shackle” Congress’ ability to keep people safe. In a second major gun case, the justices are considering whether a federal law barring firearm possession by people subject to domestic violence restraining orders violates the Second Amendment’s right to bear arms. Victims of domestic abuse rely on the law to survive. “As one study found, the risk of intimate-partner homicide increases 500% when abusers have access to a firearm,” an amicus brief submitted by domestic violence prevention groups states. “Another determined that an average of seventy (70) women are shot and killed by intimate partners per month.” When Congress decided to ban gun possession by abusers in 1994, it had found that domestic violence was “the leading cause of injury to women in the United States between the ages of 15 and 44,” and that “firearms are used by the abuser in 7 percent of domestic violence incidents.”  In a brief submitted by Democratic members of Congress, lawmakers argued that invalidating the ban would “shackle” Congress’ ability to keep people safe, and render it “unable to develop innovative solutions for the benefit of the public.” Moreover, they warn, such a decision would “generate a wave of litigation” challenging other public safety-minded gun restrictions “that will burden the courts and hamper legislatures’ ability to address public safety needs.” Public health and safety are closely tied to the environment. This term, the court heard a challenge to an EPA rule intended to protect against air pollution under the Clean Air Act. The case involves the legality of the Good Neighbor provision, which protects downwind states from harmful pollution originating in upwind states. According to the EPA, the rule will “improve air quality for millions of people living in downwind communities, saving thousands of lives, keeping people out of the hospital, preventing asthma attacks, and reducing sick days.” In 2026 alone, the agency estimated that the rule would prevent around 1,300 premature deaths and 2,300 hospital and emergency room visits, cut asthma symptoms by 1.3 million cases, and eliminate 430,000 school absence days and 25,000 lost work days. But after oral arguments in February, the court’s Republican-appointed majority appeared ready to block the provision. The case arrived at the court following a complex series of lawsuits, and the justices agreed to hear the challenge on an emergency basis, short-circuiting the lower courts. Should the Supreme Court decide to halt the EPA’s rule, it will have gone out of its way to impede environmental safety when the issue could have been left to the normal judicial process. In 1986, Congress passed the Emergency Medical Treatment and Labor Act (EMTALA), to stop hospitals from “dumping” uninsured or poor patients who showed up in need of emergency care. In 2022, Idaho banned all abortions unless the mother’s life was at risk. This conflicted with EMTALA, which requires an abortion when it is the necessary treatment to stabilize a health emergency, even when the mother’s life isn’t immediately in peril. Now, the Supreme Court is deciding whether states can subject pregnant women to undergo severe medical crises—up to and including death—in their radical crusade to end abortions. The court is deciding whether states can subject women to medical crises—including death. The effects of abortion bans on women’s health are already apparent two years after the Supreme Court overturned Roe v. Wade. The EMTALA case is about the most extreme examples: people whose safety, bodily organs, and lives are in danger yet are being denied care as a result of state abortion bans. Already, stories of women hemorrhaging in bathrooms, spending days in the ICU, and being airlifted across state lines fill the news. Failure to provide an abortion in critical cases can lead to loss of the uterus, kidney failure, stroke, hemorrhage, and death. This is a health emergency created by the Supreme Court—and if oral arguments are an indication, it will only worsen when it rewrites federal law to remove the right to emergency abortion care for pregnant people. The EMTALA case is not the only abortion case the court is deciding. The other centers on access to mifepristone, one of two drugs used in medication abortions, which, after Roe, have become the most common way to end a pregnancy. In order to stop them, a group of pro-life doctors argued that the FDA improperly okayed the drug more than two decades ago. For technical legal reasons, the justices appear unlikely to limit access to the drug this term. But the case is likely to return on stronger footing soon, and whatever its disposition, the threat such attempts represent to public health is enormous: access to safe abortions improve health and economic outcomes for women, while bans imperil women’s health.  In each of these cases, the court is contemplating doing serious harm to health and safety by undoing an action by Congress or agency experts regulating at the behest of Congress, shifting control over life and death decisions from the elected branches of government to the courts. Perhaps the most terrifying phrase about today’s government is: I’m a Supreme Court justice and I’m here to help.
